Start with the employment structure before choosing a permit

A global-mobility case should begin with the facts: who employs the professional, whether there is a pre-existing group relationship, where the person will work, who pays salary, how long the assignment will last and whether the family is relocating.

Those facts can point to very different Spanish routes. Selecting the permit first and trying to adapt the employment structure afterwards creates avoidable risk.

Highly qualified hire: national PAC or EU Blue Card

For a highly qualified professional joining a Spanish company, the comparison may be between the national PAC and the EU Blue Card. Qualification, role, salary and mobility objectives should be screened before the employment package is finalised.

Intra-company transfer (ICT)

If the professional already works within an international group and is being transferred to a Spanish entity, the intra-company-transfer framework may be more accurate than treating the move as a new local hire or as remote work.

Corporate relationship, prior employment, role and assignment structure should be documented consistently across HR and immigration files.

International remote work

The Digital Nomad / international telework route is designed for remote work for companies outside Spain. It should not be used to disguise a genuine intra-group transfer or a Spanish local-employment structure.

Researchers and innovation

Research organisations, universities and qualifying R&D+i activities can fall within specific Law 14/2013 routes. The hosting or employment structure should be identified before relying on a general work-authorisation process.

Entrepreneurs and founders

Founders whose project is innovative and/or of special economic interest to Spain may need the entrepreneur route rather than a self-employment application built under the general immigration regime.

Family relocation is part of the mobility plan

Immigration is not finished when the employee is eligible. Family civil-status documents, funds where applicable, schooling timelines, healthcare and post-arrival documentation can affect the relocation calendar. We recommend mapping family requirements at the same time as the main permit.

A practical corporate workflow

  1. Immigration screening before onboarding is fixed.
  2. Select the route and identify legal dependencies.
  3. Align contract, corporate evidence, payroll/Social Security and family strategy.
  4. Prepare and file through the competent channel.
  5. Manage requests, approval and post-arrival steps.

What HR, Legal or People should send for an initial screening

We can start with nationality, current country, role and functions, hiring or sending entity, prior relationship with the group, proposed salary, target start date, expected duration in Spain and accompanying family.
