A genuine remote-work case

The permit is not simply for anyone who uses a laptop. The duties must genuinely be capable of being performed remotely through computer, telematic and telecommunications systems.

UGE guidance notes that additional information may be requested about the company, its size, activity and organisational structure when the remote nature of the role is not obvious.

One year of real company activity

The foreign company or group supporting the application must show real and continuous activity for at least one year. Corporate registration is usually the starting point, but company owners may need more extensive evidence.

Three months of prior relationship

The applicant must show at least three months of employment or professional relationship before applying. UGE guidance expressly warns that prior employment does not automatically prove a professional relationship and vice versa.

Professional qualifications or experience

The applicant must hold qualifying higher education or professional credentials or demonstrate at least three years of relevant professional experience.

Regulated professions may require recognition under the applicable sector rules.

Financial means

The financial requirement is linked to the SMI. The applicant must also prove lawful ownership and availability of the funds relied upon.

Payslips or invoices and bank records are central to the evidentiary package.

Criminal records

The instructions require certificates from the country or countries of residence during the previous two years and a declaration concerning the previous five years, subject to the exceptions provided for applicants already holding certain Spanish permits.

Social Security and healthcare

The application must contain a workable Social Security solution. An employee and a freelancer do not follow the same route. Where home-country coverage is relied upon, the competent institution must issue the corresponding certificate.

Healthcare must also be covered in the manner accepted by the Spanish administration.

A practical pre-filing checklist

Before ordering translations and apostilles, make sure you can evidence:

  • genuinely remote duties;
  • one year of foreign-company activity;
  • three months of the correct type of relationship;
  • qualifications or experience;
  • sufficient financial means;
  • Social Security compliance;
  • criminal-record requirements;
  • legal stay in Spain if applying for residence from within Spain.

Evidence is part of the requirement

An applicant may genuinely have worked with the same overseas business for years and still fail to present the right evidence. The administration does not interview the company and reconstruct the commercial history on its own.

For each requirement, ask a second question: “What independent document proves this?” A company-registration certificate proves incorporation, but it may not prove one year of real activity. A CV describes experience, but it does not independently prove it. An invoice shows an amount billed, but not that the money was actually received.

This evidence-first approach is essential for a high-quality application.

Frequently asked questions

Does the foreign company need to be at least one year old?

The law requires real and continuous activity for at least one year. The evidence should establish that activity, not merely a date of incorporation.

Is three months of relationship always required?

The international teleworker requirements include a minimum prior employment or professional relationship of three months.

Can prior employment count as professional-contract history?

UGE guidance states that one type of relationship does not automatically evidence the other.

Do I always need a university degree?

No. The law also provides an experience-based route of at least three years where the conditions are met.

What if I am the owner of the foreign company?

UGE guidance addresses company owners and persons with effective control and may require additional corporate evidence.

Common mistakes to avoid

  • Treating incorporation as proof of real activity. This should be checked against the actual legal route and the evidence in the file. A seemingly small mismatch can create a credibility problem or lead to an unnecessary request for additional documents.
  • Using a cv as the only proof of experience. This should be checked against the actual legal route and the evidence in the file. A seemingly small mismatch can create a credibility problem or lead to an unnecessary request for additional documents.
  • Assuming any remote job qualifies. This should be checked against the actual legal route and the evidence in the file. A seemingly small mismatch can create a credibility problem or lead to an unnecessary request for additional documents.
  • Failing to match invoices with bank receipts. This should be checked against the actual legal route and the evidence in the file. A seemingly small mismatch can create a credibility problem or lead to an unnecessary request for additional documents.
  • Ignoring the legal-stay requirement for in-country filing. This should be checked against the actual legal route and the evidence in the file. A seemingly small mismatch can create a credibility problem or lead to an unnecessary request for additional documents.
  • Assuming a university degree is always mandatory. This should be checked against the actual legal route and the evidence in the file. A seemingly small mismatch can create a credibility problem or lead to an unnecessary request for additional documents.

What to do before treating the application as ready

The final review should be carried out as if the officer reading the file knew nothing about your background. Every requirement should be easy to locate and verify without the administration having to infer key facts.

For each requirement, answer three questions: what fact must be proved, which document proves it, and whether any discrepancy needs an explanation. Where evidence depends on a third party — employer, bank, university, Social Security authority or foreign registry — verify that the document is authentic, usable and issued in the appropriate form.

A strong legal review is not a file-count exercise. It should identify inconsistent dates, different company names, payment intermediaries, mismatched figures, unclear signatures or changes in the legal nature of the relationship.

The practical test is simple: if the administration had only this application bundle, would it clearly understand why the legal requirement is met? If the answer is uncertain, the file is not finished yet.

Requirement-by-requirement preparation order

Start with third-party evidence. Criminal records, corporate registry certificates, Social Security coverage certificates and former-employer experience letters can take time.

Then confirm the commercial relationship. Employment or service agreement, remote-work letter and proof of the three-month relationship.

Next reconcile money. Payslips or invoices should match bank receipts.

Then prepare qualifications and personal documents.

Finally handle formalities. Apostille/legalisation and translation should be applied to the correct final documents.

Red flags to resolve before filing

A relationship that changed legal form less than three months ago; a foreign company with less than one year of real activity; no confirmed Social Security route; payments arriving from unexplained entities; or a role whose duties appear to require a physical presence.

None of these should be hidden in the file. They should be analysed before the application is submitted.
