Start with your work structure, not with a document checklist
Spain's international telework route is designed for third-country nationals who work remotely from Spain for companies located outside Spain. Before collecting documents, the application needs to answer a basic question: are you an employee, an independent professional, or a company owner working through your own business?
Those profiles can look similar on paper but they create different evidence and Social Security issues. A strong application explains the real relationship instead of forcing every applicant into the same template.
Employee, freelancer and company owner are not the same case
For an employee, the work must be for companies located outside Spain. For an independent professional, the law allows professional activity for a Spanish company up to the statutory limit of 20% of the total professional activity.
Company owners need an additional layer of explanation: ownership, management role, the company's actual activity, how the applicant is paid and why the relationship qualifies as international remote work.
Prior relationship, company activity and professional qualification
The route requires evidence that the foreign company or group has been carrying out real and continuous activity for at least the statutory period and that the applicant has had the required prior professional relationship before filing. The applicant must also meet the qualification or professional-experience test under Law 14/2013.
These requirements should be proved through documents that tell the same story: contracts, corporate evidence, invoices or payroll, professional history and the description of the remote activity.
Income: use the legal formula in force on the filing date
The financial requirement is linked to the Spanish minimum wage (SMI). For the main applicant, the rule uses 200% of the SMI; additional percentages apply when family members are included. Because the SMI can change, we prefer to verify the legal formula and the figure in force on the actual filing date instead of relying on an old monthly amount copied from a guide.
Social Security is often the part that needs the most planning
An application can be strong on income and contracts and still have a Social Security problem. Employees and independent professionals do not prove this point in the same way. Depending on the applicable international coordination rules, the case may require Spanish Social Security registration or a valid certificate showing that the legislation of another State continues to apply.
A pending request for a foreign certificate is not the same as the certificate itself. This is one of the issues we prefer to identify before the rest of the file is treated as ready.
Applying from Spain or through a Spanish consulate
The visa and the residence authorisation are related but different procedures. Applicants outside Spain normally use the consular visa route. A person who is regularly in Spain may be able to apply for the residence authorisation before the UGE-CE if the legal requirements are met.
The residence authorisation can have a maximum validity of three years when the underlying work period allows it, with renewal available if the conditions continue to be met.
Family members
Eligible family members can be planned together with the main applicant. Family strategy affects financial evidence, civil-status documents and timing, so it is better to decide at the beginning who will move to Spain rather than add family documents at the end.
Common mistakes we see in application planning
- Using the same checklist for employees, freelancers and company owners.
- Leaving Social Security until the end.
- Relying on an old euro amount instead of the current SMI formula.
- Submitting corporate documents that do not explain who actually pays or controls the work relationship.
- Treating a visa and a residence permit as the same filing route.
- Adding family members without recalculating funds and document timing.
What to tell us in your first message
You do not need to send a passport or sensitive documents. Tell us where you are now, whether you are an employee/freelancer/company owner, where the company or clients are located, how long the relationship has existed, your approximate income, your Social Security situation and whether family members will apply with you.
